Phyata Terms & Conditions

1 Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

• "Platform" means the Phyata website at phyata.com, the Phyata mobile application, and all associated services, games, and features operated by Phyata.
• "Player" / "User" means any individual who has registered a Phyata account and is using the Platform.
• "Account" means the personal account created by a Player upon successful registration on the Phyata Platform.
• "Wallet" means the in-platform balance held in Philippine Peso (PHP) associated with a Player's Account.
• "Game" means any wagering activity available on the Phyata Platform, including but not limited to Bingo Fishing, Cockfighting, Racing, Plinko, Keno Bonus Number, Rave Party Fever, and Pappu.
• "Wager" / "Bet" means any real-money stake placed by a Player on a Game outcome using funds from their Phyata Wallet.
• "Bonus" means any promotional credit, free play, or incentive offered by Phyata to Players subject to specific terms and conditions.
• "KYC" means Know Your Customer — the identity and age verification process required by Phyata before certain account actions are permitted.
• "PAGCOR" means the Philippine Amusement and Gaming Corporation, the government body responsible for regulating gaming activities in the Philippines.

2 Acceptance of Terms

2.1 By accessing or using the Phyata Platform in any capacity — including browsing, registering, depositing, or placing a wager — you confirm that you have read these Terms and Conditions in full and agree to be legally bound by them.

2.2 These Terms apply in addition to any game-specific rules, bonus terms, or promotional conditions published on the Phyata Platform. In the event of any conflict between these Terms and game-specific rules, these Terms shall prevail unless the game-specific rules expressly state otherwise.

2.3 If you are accessing the Phyata Platform on behalf of another person or entity, you represent and warrant that you have the authority to bind that person or entity to these Terms.

2.4 Phyata reserves the right to refuse access to the Platform to any person at its sole discretion, including where Phyata has reason to believe that a person does not meet the eligibility requirements set out in Section 3.

3 Eligibility

3.1 To be eligible to register and use the Phyata Platform, you must satisfy all of the following conditions at the time of registration and at all times during your use of the Platform:

• You are at least 21 years of age;
• You are physically located in the Philippines at the time of accessing the Platform;
• You are not a resident of any jurisdiction where online gaming is prohibited by applicable law;
• You are acting on your own behalf and not as an agent or representative of any third party;
• You do not already hold an existing Phyata Account;
• You have not previously been excluded or banned from the Phyata Platform;
• You are not an employee, contractor, director, or officer of Phyata, nor an immediate family member of any such person.

3.2 Phyata may require you to provide documentary evidence of your eligibility at any time, including government-issued identification, proof of address, or other KYC documentation. Failure to provide satisfactory documentation within the timeframe specified by Phyata may result in account suspension and withholding of any pending withdrawals pending verification.

3.3 It is your sole responsibility to ensure that your use of the Phyata Platform complies with all laws and regulations applicable to you in your jurisdiction. Phyata accepts no liability for any Player who accesses the Platform from a jurisdiction where such access is restricted or prohibited.

4 Account Registration

4.1 To access real-money games on Phyata, you must create an Account by completing the registration process at phyata.com/register. You agree to provide accurate, current, and complete information during registration and to update such information promptly if it changes.

4.2 Each Player is permitted to hold only one (1) Phyata Account. The creation of multiple accounts by a single Player — whether under the same or different names, email addresses, or payment methods — is strictly prohibited and constitutes a material breach of these Terms.

4.3 You are solely responsible for maintaining the confidentiality of your Account login credentials, including your username and password. You must not share your login credentials with any other person. Phyata will not be liable for any loss or damage arising from unauthorised access to your Account resulting from your failure to keep your credentials secure.

4.4 You must notify Phyata immediately if you become aware of any unauthorised use of your Account or any other security breach. Phyata may temporarily suspend your Account pending investigation of any reported security incident.

4.5 Phyata reserves the right to verify the identity of any Player at any time. Where verification is required, you must provide the following documents within the timeframe specified:

• A valid government-issued photo identification (e.g., Philippine passport, SSS ID, PhilSys National ID, driver's licence, or UMID card);
• Proof of current residential address (e.g., utility bill, bank statement, or barangay certificate issued within the last three months);
• Proof of ownership of the payment method used for deposits (e.g., screenshot of GCash or PayMaya account showing your registered name).

4.6 Phyata reserves the right to close any Account that is found to have been registered with false, inaccurate, or misleading information. Any balance in such an Account may be forfeited at Phyata's discretion.

5 Deposits & Payments

5.1 All transactions on the Phyata Platform are conducted in Philippine Peso (PHP). Phyata does not accept deposits in foreign currencies. Any currency conversion costs incurred by a Player through their payment provider are the sole responsibility of the Player.

5.2 Phyata accepts deposits via the following payment methods:

• GCash e-wallet;
• PayMaya (Maya) e-wallet;
• BPI online banking;
• BDO online banking;
• Metrobank online banking.

5.3 Deposits made via GCash and PayMaya are credited to your Phyata Wallet instantly upon confirmation from the payment provider. Bank transfer deposits are credited upon receipt of cleared funds, which may take up to one (1) business day depending on the sending bank.

5.4 Phyata does not charge fees on deposits. However, your payment provider may apply their own transaction fees, which are outside Phyata's control.

5.5 You may only deposit funds from payment accounts registered in your own name. Deposits from third-party accounts are not permitted and may result in the suspension of your Phyata Account and the return of deposited funds to the originating account.

5.6 Phyata reserves the right to set minimum and maximum deposit limits, which may vary by payment method and account verification status. Current limits are displayed during the deposit process within your Account.

6 Withdrawals

6.1 You may request a withdrawal of available funds from your Phyata Wallet at any time, subject to the conditions set out in this Section and any applicable verification requirements.

6.2 Withdrawals will be processed to the same payment method used for your most recent deposit, where technically possible. Phyata reserves the right to process withdrawals via an alternative method where the original method is unavailable.

6.3 Phyata does not charge fees on standard withdrawal transactions. Processing times are as follows:

• GCash and PayMaya: Typically within 15 minutes of approval;
• BPI, BDO, and Metrobank: Within the same business day for requests submitted before 3:00 PM Philippine Standard Time (PST); next business day for requests submitted after 3:00 PM PST.

6.4 Phyata may require full KYC verification before processing any withdrawal. Where verification documents have not yet been submitted or approved, withdrawal processing may be delayed until verification is complete.

6.5 Phyata reserves the right to withhold or delay any withdrawal where there is a reasonable suspicion of fraudulent activity, bonus abuse, or breach of these Terms, pending investigation. Phyata will notify you of any such hold within a reasonable timeframe.

6.6 Minimum and maximum withdrawal amounts apply and are displayed within your Account during the withdrawal process. Phyata reserves the right to adjust these limits at any time with reasonable notice.

7 Bonuses & Promotions

7.1 Phyata may offer bonuses, free plays, cashback, and other promotional incentives to Players from time to time. All bonuses are subject to specific terms and conditions that will be published alongside each promotion.

7.2 Unless otherwise stated in the applicable promotion terms, the following general bonus conditions apply to all Phyata bonuses:

• Bonuses are available to eligible Players only and may not be transferred, exchanged for cash, or combined with other offers unless expressly permitted;
• Wagering requirements must be met in full before any bonus-derived winnings can be withdrawn;
• Bonuses are valid for the period specified in the promotion terms; unused bonuses will expire automatically at the end of the validity period;
• Phyata reserves the right to withdraw, modify, or cancel any bonus at any time where there is evidence of abuse or where a technical error has resulted in an incorrect bonus being credited.

7.3 Players who are found to be abusing the Phyata bonus system — including through the creation of multiple accounts, coordinated wagering with other Players, or any other method designed to circumvent wagering requirements — will have their bonuses forfeited and their Accounts suspended.

8 Game Rules & Fair Play

8.1 Each game available on the Phyata Platform is governed by its own specific rules, which are accessible within the game interface. By placing a wager on any game, you confirm that you have read and understood the applicable game rules.

8.2 All games on the Phyata Platform use certified random number generators (RNG) that are independently audited. Game outcomes are determined solely by the RNG and cannot be influenced by Phyata, the Player, or any third party.

8.3 In the event of a technical malfunction, disconnection, or system error during a game round, Phyata will use all reasonable efforts to resolve the issue and restore the game to its correct state. Where a round cannot be completed due to a technical fault, Phyata reserves the right to void the affected wager and return the staked amount to the Player's Wallet.

8.4 Phyata's decision on all game-related disputes is final. Where a Player disputes a game outcome, they must submit a formal complaint to Phyata's support team within seven (7) days of the disputed round. Complaints submitted after this period may not be considered.

8.5 Phyata reserves the right to void any wager that was placed as a result of a pricing or odds error, a software bug, or any other technical fault that resulted in an incorrect game state being presented to the Player.

9 Prohibited Conduct

9.1 The following conduct is strictly prohibited on the Phyata Platform. Engaging in any prohibited conduct constitutes a material breach of these Terms and may result in immediate Account suspension, forfeiture of balances, and reporting to relevant authorities:

• Registering more than one Account on the Phyata Platform;
• Providing false, inaccurate, or misleading information during registration or KYC verification;
• Using automated software, bots, scripts, or any other tool to place wagers or interact with the Platform without human input;
• Exploiting software errors, glitches, or vulnerabilities in the Platform or any game;
• Colluding with other Players to gain an unfair advantage in any game;
• Engaging in any form of money laundering, fraud, or other financial crime using the Phyata Platform;
• Accessing the Platform from a jurisdiction where online gaming is prohibited;
• Allowing any other person to access or use your Phyata Account;
• Engaging in any conduct that is abusive, threatening, or harassing toward Phyata staff or other Players;
• Attempting to reverse-engineer, decompile, or otherwise tamper with any part of the Phyata Platform or its underlying software.

10 Responsible Gaming

10.1 Phyata is committed to promoting responsible gaming and providing tools that help Players maintain control over their gaming activity. Gaming on Phyata should be an enjoyable form of entertainment — not a source of financial stress or personal harm.

10.2 The following responsible gaming tools are available to all Phyata Players through their Account settings:

• Deposit Limits: Set daily, weekly, or monthly caps on the amount you can deposit into your Phyata Wallet;
• Session Reminders: Receive notifications after a set period of continuous play;
• Cooling-Off Periods: Temporarily suspend your Account for 24 hours, 7 days, or 30 days;
• Self-Exclusion: Permanently or temporarily exclude yourself from all real-money gaming on Phyata.

10.3 If you believe you may have a problem with gambling, Phyata strongly encourages you to use the self-exclusion tool immediately and to seek professional support. You can also contact Phyata's support team to activate any restriction on your Account.

10.4 Phyata will not knowingly permit any person under 21 years of age to register or play on the Platform. If you are aware of a minor attempting to access Phyata, please contact our support team immediately.

11 Intellectual Property

11.1 All content on the Phyata Platform — including but not limited to text, graphics, logos, game interfaces, software, audio, and video — is the intellectual property of Phyata or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

11.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Phyata Platform for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to:

• Copy, reproduce, or distribute any content from the Phyata Platform without prior written consent;
• Modify, adapt, or create derivative works based on any Phyata content;
• Use any Phyata trademarks, logos, or branding without prior written authorisation;
• Frame or mirror any part of the Phyata Platform on any other website or application.

11.3 Any unauthorised use of Phyata's intellectual property may result in legal action. If you believe that any content on the Phyata Platform infringes your intellectual property rights, please contact us at the address provided in Section 16.

12 Limitation of Liability

12.1 To the maximum extent permitted by applicable law, Phyata shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to loss of winnings, loss of data, or loss of profits.

12.2 Phyata does not warrant that the Platform will be available at all times, free from errors, or free from viruses or other harmful components. Phyata will use reasonable efforts to maintain Platform availability but does not guarantee uninterrupted access.

12.3 Phyata's total aggregate liability to any Player in connection with these Terms or the use of the Platform shall not exceed the total amount deposited by that Player in the twelve (12) months preceding the event giving rise to the claim.

12.4 Nothing in these Terms shall limit or exclude Phyata's liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable Philippine law.

13 Account Suspension & Termination

13.1 Phyata reserves the right to suspend, restrict, or permanently close any Player Account at any time and without prior notice where Phyata has reasonable grounds to believe that:

• The Player has breached any provision of these Terms;
• The Player has provided false or misleading information;
• The Player's Account has been used for fraudulent, illegal, or abusive activity;
• The Player does not meet the eligibility requirements set out in Section 3;
• Phyata is required to do so by applicable law or regulatory authority.

13.2 Where an Account is suspended pending investigation, Phyata will notify the Player via their registered email address within a reasonable timeframe. Any funds held in the Account at the time of suspension will be retained pending the outcome of the investigation.

13.3 You may close your Phyata Account at any time by contacting our support team. Upon closure, any remaining balance in your Wallet will be returned to your registered payment method, subject to completion of any outstanding KYC verification and provided no breach of these Terms has occurred.

14 Governing Law & Dispute Resolution

14.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

14.2 Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall first be submitted to Phyata's internal dispute resolution process. Players must submit a formal complaint to Phyata's support team and allow Phyata a reasonable period of not less than thirty (30) days to investigate and respond before pursuing any other remedy.

14.3 If a dispute cannot be resolved through Phyata's internal process, the parties agree to submit to the exclusive jurisdiction of the competent courts of the Philippines.

14.4 Phyata's decision on all matters relating to game outcomes, bonus eligibility, and account status is final and binding, subject only to the dispute resolution process described in this Section.

15 Amendments to These Terms

15.1 Phyata reserves the right to amend, update, or replace these Terms and Conditions at any time. The most current version of these Terms will always be available at phyata.com/terms-conditions.

15.2 Where Phyata makes a material change to these Terms, we will notify registered Players via their registered email address at least seven (7) days before the change takes effect, where reasonably practicable.

15.3 Your continued use of the Phyata Platform after any amendment to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may close your Account in accordance with Section 13.3.
